Conditions of sale and refund

In addition to the Terms of Use which govern your use of this site, ottofficial.com (the “Site”), these Terms of Sale govern any order or purchase you (the person completing such order, “you”) make on the Site operated by OttOfficial. By placing an order and accepting these conditions of sale, you agree to be bound by them, whether or not you have read them. If you do not accept these terms and conditions, please do not proceed with your order. Please print and keep a copy of these conditions of sale for your records.

Order process

All products on the Site are invitations to buy and not offers to sell. OttOfficial reserves the right, at its sole discretion, to accept or decline the order once you have completed and placed your order. You will receive an online confirmation that your order has been received by OttOfficial after placing your order on the Site. This online confirmation of receipt of your order by OttOfficial does not constitute acceptance of your order. Instead, confirmation of acceptance of your order will be delivered via an automatic e-mail to the e-mail address associated with your account.

Order rejection or cancellation

There may be certain orders that OttOfficial must reject prior to acceptance or cancel after acceptance. OttOfficial reserves the right at any time after receipt of your order to accept or decline your order for any reason and OttOfficial will contact you at the email address provided in the order form of its decision to accept or decline your order. In the event that OttOfficial rejects the order, OttOfficial will have no obligation to honor your order and you will have no obligation to pay OttOfficial for the order.
Some situations that may result in the rejection or cancellation of your order include:

– Limitations on quantities available for purchase ;

– Inaccuracies or errors in product or pricing information;

– A product recall on the item you purchased; or

– Problems identified by OttOfficial’s credit and fraud prevention department.

OttOfficial may also require additional verification or information before accepting any order. OttOfficial will contact you if all or part of your order is rejected after your order has been placed but before it has been accepted by OttOfficial or if additional information is required to accept your order.

Product availability and description

The purchase of products on the Site is subject to availability. In the event OttOfficial notifies you that products are no longer available, OttOfficial will have no obligation to fulfill your order and you will have no obligation to pay OttOfficial for the order. Product descriptions, representations, warranties, guarantees and performance claims are provided by our suppliers, where applicable. While the Site tries to be precise in its product descriptions. OttOfficial does not represent or warrant that product descriptions or other content of this site is accurate, complete, reliable, current or error-free. If you find that a product you purchase does not conform to its description, your only recourse is to return it in accordance with OttOfficial’s return policy.

Means of payment

You may pay for your purchase using VISA, MasterCard or American Express and you authorize OttOfficial to charge the applicable card for the purchase price and you represent and warrant that you are the cardholder of the applicable card. If your card is rejected by the card issuer, your order will not be shipped and OttOfficial will have no obligation to honor your order. You may pay for your purchase using PayPal, Gift Card and you represent and warrant that you have the right to use the payment methods you provide to us. If your payment method is rejected by the supplier or does not have sufficient funds, your order will not be shipped and OttOfficial will have no obligation to honor your order. All billing and registration information you provide to OttOfficial must be true and accurate. The provision of misleading or inaccurate information constitutes a breach of these General Terms and Conditions of Sale.

Your credit card will only be charged once the order has been shipped. Orders paid for with a gift card, e-gift card or PayPal will be debited at the time the order is placed.

Shipping

Your order will be shipped by a third-party carrier from <Canada Post>. The exact carrier delivering your item(s) will be identified in the shipping confirmation e-mail you receive once your order has been shipped. For home delivery, the products you have purchased can be shipped separately. If your products are shipped separately, the purchase price of your items, which includes shipping costs, will be charged to your credit card selected by OttOfficial in one or more charges, as the products are shipped (except for orders paid with Gift Card, eGift Card, PayPal where you will be charged at the time your order is placed).

Cancellation, returns, refunds and exchanges

You may have certain statutory rights to cancel your order under applicable provincial consumer protection laws in your country and OttOfficial will comply with all such applicable laws. In addition to these statutory rights, returns of products purchased on the Site are governed by OttOfficial’s Returns Policy. Please refer to the applicable return policy and print and retain a copy for your records. OttOfficial will not exchange orders placed online. Customers wishing to exchange an item purchased on the Site will be required to return their purchase in accordance with OttOfficial’s Return Policy, and then place a new order for the desired item.

Ottofficial may modify its terms and conditions of sale from time to time in accordance with applicable law. Such a modification will apply to all orders placed after the effective date of the modification. Therefore, each time you place an order with OttOfficial, you declare that you have consulted, read and accepted the applicable conditions of sale governing this order.

Taxes and eco-fees

We have chosen to ship with <Canada Post> because their system allows you to charge sales tax or environmental management, recycling or disposal fees (“eco-fees”) on items sold by OttOfficial depending on your country and shipping address. We pay for you all sales taxes or eco-fees charged according to the laws applicable in your country.
